1. Acceptance of Terms

By accessing or using Rewardata ("the Site" or "the Service"), including its API, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use. If you do not agree to these Terms, you must immediately discontinue use of the Site and the API.

These Terms constitute a legally binding agreement between you and Smitteck GmbH ("the Company"), the owner and operator of the Site.

The Company reserves the right to update or modify these Terms at any time without prior notice. Any changes take effect immediately upon publication on the Site. Continued use after such changes indicates your acceptance of the revised Terms.

2. Ownership and Legal Entity

The Site is owned and operated by Smitteck GmbH, a company incorporated and existing under the laws of Switzerland, registered in the Canton of Zurich. All rights, titles, and interests in the Site, including its design, software, API, databases, and underlying infrastructure, belong to Smitteck GmbH unless explicitly stated otherwise.

Unauthorized use of the Site or its materials may constitute a violation of Swiss intellectual property laws and international treaties.

3. Purpose and Scope

Rewardata is an information and data platform that aggregates, normalises, and provides access to publicly available HR, compensation, taxation, social security, and labor market data from official statistical sources worldwide. The data and information provided:

  • is for general informational, research, and analytical purposes only,
  • does not constitute or substitute for professional legal, tax, or financial advice,
  • may not reflect the most current data releases or legislative changes, and
  • should not be relied upon as the sole basis for employment, compensation, or compliance decisions without consulting qualified professionals.

Rewardata provides statutory and official statistical data. It is not a salary benchmarking service and does not collect or distribute company-reported compensation surveys.

4. No Professional Advice or Relationship

Your use of this Site or API does not create any form of advisor-client, consultant-client, or fiduciary relationship between you and Smitteck GmbH, its employees, or contributors. Communications sent via the Site or any associated contact forms are not confidential and should not contain sensitive or privileged information.

5. API Use License

Subject to these Terms, the Company grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Rewardata API under the following conditions:

  • You must maintain the confidentiality of your API key and not share it with third parties
  • You must not exceed your subscription tier's rate limits
  • You must properly attribute data sources as specified in API responses (see Section 6)
  • You must not attempt to circumvent security measures, rate limits, or access controls
  • You must not use the API for any unlawful purpose or to build a competing data service

The Company reserves the right to revoke or suspend API access at any time for violation of these Terms.

5.1 Internal Use Restriction (All Plans)

All Rewardata subscription plans (Free, Professional, and Enterprise) are licensed exclusively for your organisation's own internal planning, analysis, and decision-making purposes — primarily Total Rewards, Compensation, and People Analytics work for your own employees. Across all plans, you may not:

  • resell, sublicense, redistribute, or make available the data (in whole or in part) to third parties, whether for a fee or free of charge;
  • embed, integrate, or bundle the data into any product, platform, report, or service that is sold, licensed, or otherwise provided to third parties; or
  • use the data to provide data-as-a-service, consulting deliverables incorporating raw data exports, or any form of data brokerage.
5.2 Compliance

If your intended use is consulting, vendor, redistribution, or any service offered to third parties, Rewardata is not the right product for you and you should not subscribe. Use of any plan for redistribution purposes constitutes a material breach of these Terms and may result in immediate termination of access and liability for damages.

6. Data Attribution

Data provided through Rewardata originates from official statistical agencies and international organisations including, but not limited to, the OECD, World Bank, ILO, Eurostat, and IMF. When you use or republish data obtained from the API, you must include proper attribution to the original source as indicated in the source_name and source_url fields of each data point.

You are responsible for complying with the terms of use of the original data providers.

7. Accuracy and Completeness of Data

Smitteck GmbH strives to ensure that the data presented is accurate and up to date. However, given the volume of data and the evolving nature of official statistics, no guarantee is made as to the accuracy, reliability, or completeness of any data on the Site or API. The Company expressly disclaims responsibility for:

  • outdated, incomplete, or revised data from upstream sources,
  • errors introduced during data normalisation or processing,
  • or any loss or damage resulting from reliance on the data provided.

You are encouraged to verify critical data points with official source publications.

8. No Warranties

The Site, API, and all data are provided "as is" and "as available" without warranties of any kind, whether express or implied. Without limitation, Smitteck GmbH makes no warranty that:

  • the Site or API will be available at all times, error-free, or secure;
  • the data is accurate, reliable, complete, or suitable for any particular purpose; or
  • any identified data points or statistical references are current or reflect the latest revisions.

To the fullest extent permitted by law, all implied warranties of merchantability, fitness for a particular purpose, and non-infringement are expressly excluded.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Smitteck GmbH, its directors, employees, affiliates, contractors, or partners shall not be liable for any losses or damages of any kind — whether direct, indirect, incidental, consequential, or punitive — arising from:

  • access to, use of, or inability to use the Site or API;
  • reliance on any data or information provided;
  • links to third-party resources; or
  • any technical errors, omissions, interruptions, or data loss.

This limitation applies even if Smitteck GmbH has been advised of the possibility of such damages. You agree that your sole remedy for dissatisfaction with the Service is to discontinue its use.

10. Indemnification

You agree to indemnify, defend, and hold harmless Smitteck GmbH, its officers, employees, affiliates, contractors, and agents from and against any and all claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising from or related to your use of the Site or API, your violation of these Terms, or your infringement of any third-party rights.

11. Intellectual Property Rights

All content on the Site — including text, graphics, data compilations, databases, API design, logos, and design elements — is protected by Swiss and international intellectual property laws. You may:

  • use data retrieved through the API in accordance with your subscription tier and these Terms; and
  • cite or quote brief excerpts with proper attribution to Rewardata and the original source.

You may not reproduce, republish, distribute, modify, scrape, or commercially exploit the Site, its design, or its database structure without prior written consent from Smitteck GmbH.

12. Third-Party Links and Data Sources

The Site and API may reference or link to external websites, databases, or statistical resources operated by third parties. These are provided for convenience and attribution. Smitteck GmbH does not endorse, control, or assume responsibility for the content, accuracy, privacy practices, or availability of external sites. Accessing such links is at your own risk.

13. Suspension or Termination

Smitteck GmbH reserves the right, at its sole discretion and without prior notice, to suspend, restrict, or terminate access to the Site, API, or any part of the Service if it believes that a user has violated these Terms, exceeded usage limits, or acted in a manner harmful to the Service or other users. The Company shall not be liable for any resulting loss or inconvenience.

14. Governing Law and Jurisdiction

These Terms, and any dispute or claim arising out of or in connection with them or the use of the Site or API, shall be governed exclusively by the laws of Switzerland, without regard to conflict of law principles. The competent courts of Zurich, Canton of Zurich, Switzerland, shall have exclusive jurisdiction to resolve all disputes.

15. Severability

If any provision of these Terms is held invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms constitute the entire agreement between you and Smitteck GmbH concerning use of Rewardata and supersede any prior agreements, representations, or understandings, whether oral or written.
